TERMS OF USE (Peakify.ai)

1. Overview of the Service

Peakify allows users to:

• Create and manage races
• Import GPX files
• Add and customise checkpoints
• Track their own live position during a race
• Share a live tracking link with friends, family, and support crews
• View live progression and checkpoints inside the app
• Subscribe for additional features

Peakify is not intended for emergency use. Always use appropriate safety practices during outdoor activities and races.

2. Subscription & Billing

Peakify offers optional auto-renewing subscriptions.

• Payment is charged to your Apple ID upon purchase confirmation.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Your Apple ID will be charged for renewal within 24 hours before the new period begins.
• Manage or cancel your subscription in Settings > Apple ID > Subscriptions.
• If you cancel, your subscription remains active until the end of the billing cycle. We do not offer partial refunds.

Premium features include:

• Unlimited races
• Unlimited checkpoints
• No ads

A free tier is available with limited features.

3. User Accounts

Creating an account may be required for certain features. You are responsible for:

• Providing accurate information
• Maintaining the confidentiality of your login credentials
• All activity occurring under your account

We may suspend or terminate accounts that violate these Terms.

4. Location Usage

Peakify uses location services to:

• Track your live position during races
• Display your position inside the app
• Update location information to your shared live tracking link

You choose when tracking is enabled. You can disable location access anytime in device settings.

5. Acceptable Use

You agree not to:

• Use the App for illegal or unsafe activities
• Misuse live tracking features to monitor others without consent
• Attempt to reverse-engineer, modify, or copy the App
• Interfere with App operation or servers

6. Intellectual Property

All App content - design, code, branding, graphics - is owned by Peakify. You may not reproduce, distribute, or modify any part of the App without approval.

7. Disclaimer

Peakify is provided "as is," without warranties of any kind. We do not guarantee:

• Perfect GPS accuracy
• Continuous availability
• Error-free operation
• Exact timing of location updates
• Network performance or map accuracy

Use the App at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, Peakify is not liable for:

• Any damages resulting from use or inability to use the App
• GPS inaccuracies or delays
• Incorrect or missing location updates
• Loss of data or race progress
• Issues caused by third-party networks, devices, or services

9. Changes to These Terms

We may update these Terms of Use. Changes take effect when posted in the App or on our website.
